(a) Payment Terms; Orders:
An order is not binding upon DOORBRIM Rain Diverters until it is accepted; DOORBRIM Rain Diverters must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, wire transfer, or some other method prearranged with DOORBRIM Rain Diverters. You agree to pay the amount(s) due as specified on the invoice.
(b) Sales & Use Tax:
7% Sales Tax is added to shipments all Florida orders.
(c) Shipping Charges:
An ESTIMATED fixed fee per TIME ZONE will be used to calculate UPS Ground shipping to Continental USA. We reserve the right to notify Buyers if an upward adjustment is necessary (ACTUAL COST IS >10% ESTIMATED COST) depending on their delivery address. Buyers should also call for reduced shipping rates for multiple items. International buyers should email us to determine shipping costs prior to placing their order.
Your total cost for purchase of any product will include shipping and handling charges shown on the DOORBRIM Rain Diverters invoice.
(d) Title; Risk of Loss:
DOORBRIM Rain Diverters will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. DOORBRIM Rain Diverters will advise Customer of estimated shipping dates, but DOORBRIM Rain Diverters will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.
(e) Warranty:
DOORBRIM Rain Diverters warranties against manufacturers defects for a period of one year after purchase date. Warranty does not cover cracking at pre-drilled holes due to over tightening fasteners.
(f) Returns:
Buyer may return unused DOORBRIM products with the original packing material and box within 14 calendar days after receipt. Buyer is responsible for the cost of original & return shipping costs. Buyer must request a “Return Authorization Number” and shipping instructions by contacting us here https://doorbrim.com/contact-us/. Please indicate 1) a request to return merchandise and 2) the reason for return. A 20% restocking fee for additional handling and repackaging will be charged.
Custom fabricated sizes using a splice bracket (EXTENDED and SHORTER WIDTHS specifically) are NOT RETURNABLE. Please verify all colors and dimensions. If you are unsure if our product will work for your application, you are encouraged to contact Customer Service or send us a photo of your door(s) or window(s) which we will review and offer our recommendation.
If your shipment arrives damaged, you must email images 1) of the damaged merchandise to admin@doorbrim.com, including 2) packing and 3) box. Damaged merchandise cannot be replaced without these images. These images are required for DOORBRIM Rain Diverters to file a claim with the carrier.
(g) Governing Law and Jurisdiction:
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between DOORBRIM Rain Diverters and Customer shall be governed by the laws of the State of Florida, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. DOORBRIM Rain Diverters and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of Florida, Broward County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against DOORBRIM Rain Diverters that is more than one year after the date of the applicable invoice.
(h) Severability:
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Florida law.
(i) Waiver:
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such continuing waiver is made in writing.
(J) Image and Video Submission Disclaimer:
By submitting any images, videos, or other media content (“Content”) to DoorBrim Rain Diverter, you hereby grant DoorBrim Rain Diverter, its affiliates, licensees, and assigns an irrevocable, worldwide, royalty-free, perpetual, and unrestricted license to use, reproduce, distribute, modify, publicly display, and create derivative works from the submitted Content in any format or medium, for any purpose, including but not limited to marketing, advertising, promotional, and commercial uses.
You affirm that you are the rightful owner of the submitted Content or have obtained all necessary rights, permissions, and consents to grant this license. You waive any right to compensation, attribution, or approval of use and release DoorBrim Rain Diverter from any and all claims or liability relating to the use of the Content as described above.
Do not submit Content if you do not agree to these terms.
(k) Mobile Terms of Service – DOORBRIM Rain Diverters

The DOORBRIM Rain Diverters mobile message service (the “Service”) is operated by DOORBRIM Rain Diverters (“DOORBRIM Rain Diverters”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to DOORBRIM Rain Diverters’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of DOORBRIM Rain Diverters through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with DOORBRIM Rain Diverters. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +17544001357 or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other DOORBRIM Rain Diverters mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

(l) Entire Agreement:
These terms and conditions, together with the DOORBRIM Rain Diverters invoice respecting the products ordered by Customer, are the complete and exclusive agreement DOORBRIM Rain Diverters between DOORBRIM Rain Diverters and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between DOORBRIM Rain Diverters and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
